Terms of Service

1. Acceptance of Terms

By accessing, browsing, registering for, or using Bommel Bot(“the Service”), including any subdomains, mobile applications, or related services, provided by Fjord LLC(“we,” “us,” “our,” or “Company”), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service (“Terms” or “Agreement”).

These Terms constitute a legally binding agreement between you (“User,” “you,” or “your”) and Fjord LLC. If you do not agree to these Terms in their entirety, you must immediately discontinue all access to and use of the Service.

Modifications: We reserve the right, at our sole discretion, to modify, update, or replace these Terms at any time. Material changes will be effective immediately upon posting. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms. You are responsible for reviewing these Terms periodically.

2. Nature of Service

Bommel Bot is a bookmark organization service with a private, local-first library and optional public sharing features. The Service facilitates personal data management, file processing, discovery, and artificial intelligence-driven tasks.

Private and Public Content

Your library remains private unless you deliberately publish a bookmark, collection, profile field, file, or comment through a sharing control. Published content can be viewed, indexed, discussed, and discovered by other users and search engines. You are responsible for content you choose to publish.

Service Tiers and Subscriptions

The Service is provided across two subscription tiers: Free and Pro. Every signed-in, verified Free account receives cloud sync for bookmarks and notes (up to 100 bookmarks, no file attachments). The paid Pro tier unlocks unlimited bookmarks, file attachments, expanded file storage, document processing powered by the Firebase Product Family, library backup and export, AI cover thumbnails, and an ad-free experience.

Advertising

Eligible Free-tier bookmark card views may contain clearly labeled Google AdSense units. Pro users do not receive those units, and public profiles owned by Pro users are ad-free. Advertising availability, content, and measurement are provided by Google and may depend on your location, consent choices, and browser settings. You must not click ads fraudulently, encourage others to click them, or interfere with ad delivery or measurement.

Service Availability and Discontinuation

Fjord LLC reserves the right to modify, suspend, discontinue, or terminate the Service, or any portion thereof, at any time, with or without notice, for any reason or no reason, including but not limited to business, technical, or legal reasons. We shall not be liable to you or any third party for any such modification, suspension, discontinuation, or termination.

3. Data Processing and Private Infrastructure

Third-Party Reliance

You acknowledge and agree that file storage, database hosting, authentication, and payment processing are executed entirely via third-party service providers (including Google, the Firebase Product Family, and Stripe). Fjord LLC is not responsible for, and expressly disclaims all liability related to:

  • The reliability, availability, or quality of third-party cloud infrastructure
  • Network outages or service interruptions of these backend providers
  • Data loss occurring due to third-party hardware or software failures

User Responsibility for Data

You are solely and exclusively responsible for the content, documents, and images you upload, transmit, or process via the Service. Fjord LLC assumes no liability for the accuracy, legality, or integrity of the data you choose to store or manipulate using the platform.

Security

We implement reasonable technical and organizational security measures to protect the Service and your data — including encryption in transit (TLS) and at rest, authentication and per-user data isolation, least-privilege access, input validation, and minimal logging that excludes credentials and secrets. A full description of these measures, your own security responsibilities, and how to report a vulnerability is set out in the Security section of our Privacy Policy. No security measures are perfect, and you acknowledge that you use the Service at your own risk as described below.

4. User Eligibility, Account Registration, and Authentication

Age Requirement and Eligibility

To use the Service, you must be at least 18 years of age and have the legal capacity to enter into binding contracts in your jurisdiction. By using the Service, you represent and warrant that:

  • You are at least 18 years old
  • You have the legal right, authority, and capacity to agree to these Terms
  • You are not prohibited from using the Service under applicable laws
  • You have not been previously banned or suspended from the Service
  • All information you provide is accurate, current, and complete

Data Collection and Payments

We store only the account information and files you voluntarily provide or upload. For users utilizing the paid Pro tier, all payment processing and subscription management are handled securely through Stripe. We do not store your financial account information on our servers.

Authentication Methods

The Service offers multiple authentication methods:

  • Google OAuth:You may authenticate using a valid Google account through Google’s OAuth service
  • Email/Password: You may register and authenticate using an email address and password

Account Security

You are solely responsible for:

  • Maintaining the security and confidentiality of your account credentials
  • All activities that occur under your account
  • Maintaining the security of your device and any third-party accounts used for authentication
  • Notifying Fjord LLC immediately of any unauthorized access or security breach

Account Termination and Suspension

Fjord LLC reserves the right, in its sole discretion, to suspend, terminate, or delete your account at any time, with or without notice, for any reason or no reason, including but not limited to:

  • Violation of these Terms
  • Fraudulent, deceptive, or illegal activity
  • Providing false, inaccurate, or misleading information
  • Use of the Service for unauthorized commercial purposes
  • Uploading malicious files or attempting to breach platform security

5. Assumption of Risk, Release of Liability, and No Warranties

Assumption of Risk

You acknowledge and agree that your use of the Service is entirely at your own risk. You assume full responsibility for all risks associated with processing data, relying on AI outputs, and utilizing cloud storage within the Service.

Comprehensive Release of Liability

To the fullest extent permitted by law, you hereby release, discharge, and hold harmless Fjord LLC, its officers, directors, employees, agents, affiliates, successors, and assigns from any and all claims, demands, damages, losses, liabilities, and causes of action of any kind, whether known or unknown, arising from or related to:

  • Any harm, injury, loss, or corruption of data resulting from your use of the Service
  • Any reliance on AI-generated outputs, information, or processing provided by the Service
  • Security incidents or data breaches involving third-party infrastructure

No Warranties

The Service is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or accuracy. Fjord LLC does not warrant that:

  • The Service will be uninterrupted, secure, or error-free
  • Defects will be corrected
  • The Service is free of viruses or other harmful components
  • The Service will meet your specific technical requirements or expectations

6. User Conduct and Prohibited Uses

We reserve the right, in our sole discretion, to suspend, terminate, or ban accounts for violations of these Terms. You agree NOT to use the Service to:

  • Upload, store, or transmit any illegal, malicious, or highly restricted data
  • Interfere with or disrupt the Service, servers, or networks connected to the Service
  • Attempt to gain unauthorized access to the Service, other accounts, or computer systems
  • Use automated systems, bots, scripts, or scrapers to abuse platform resources
  • Reverse engineer, decompile, or disassemble any portion of the Service
  • Bypass or attempt to bypass any payment gateways or tier restrictions
  • Use the Service for any illegal commercial purpose without our express written consent

7. Public Sharing, Content Standards, and Child Safety

Publicly Shared Content

Certain optional features let you publish content to a world-readable surface — including your public profile (handle, display name, bio, location, and contact links), the names and descriptions of your public collections, and any bookmarks you explicitly choose to publish. Nothing is public unless and until you deliberately publish it; your library is private by default. You are solely responsible for anything you make public, and you represent that you have the right to share it.

Prohibited Content

When you publish any content, or set any public-facing name, description, or profile field, you agree that it will NOT contain, promote, link to, or facilitate:

  • Sexual, pornographic, or sexually explicit material, or content that is otherwise obscene
  • Any content that sexualizes, exploits, endangers, or depicts minors (persons under 18) in any way — see the zero-tolerance section below
  • Harassment, hate speech, threats, or content that incites violence
  • Content that is unlawful, infringes the intellectual property or privacy rights of others, or violates any applicable law
  • Malware, spam, deceptive links, or attempts to defraud other users

Public collection names must follow a simple schema (short, at most a few words and a limited number of characters, using ordinary letters, numbers, and spaces) so the public directory and filters remain usable. We may reject, remove, rename, or unpublish any content that violates these standards, at our sole discretion and without notice.

Zero Tolerance for Child Sexual Abuse Material (CSAM)

The exploitation or abuse of children will not be tolerated under any circumstances. You must never upload, store, publish, share, request, or link to any image, video, document, text, or other material that sexualizes, exploits, or endangers a minor, or that constitutes child sexual abuse material. All users must be at least 18 years old, and this prohibition applies regardless of a user’s age or intent.

Where we become aware of apparent child sexual abuse material or the sexual exploitation of a minor, we will preserve the relevant information and report it to law enforcement, including the U.S. National Center for Missing & Exploited Children (NCMEC) and/or the Federal Bureau of Investigation (FBI), as well as any other competent authorities, and we will cooperate fully with any resulting investigation. We will immediately and permanently terminate any account involved. This obligation overrides any other provision of these Terms, including any limitation on our disclosure of your information.

8. Limitation of Liability and Damages

To the fullest extent permitted by applicable law, Fjord LLC, its officers, directors, employees, agents, affiliates, successors, and assigns shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to:

  • Loss of profits, revenue, data, use, goodwill, or other intangible losses
  • Technical issues related to internet providers or third-party cloud services (Firebase, Google, Stripe)
  • Unauthorized access to or use of your account or data
  • Service interruptions, errors, or defects
  • Data breaches, security incidents, or loss of uploaded documents/images
  • Any harm resulting from your reliance on the Service’s outputs

In no event shall Fjord LLC’s total liability to you for all claims exceed the amount you paid to Fjord LLC in the twelve (12) months prior to the action giving rise to liability, or one hundred dollars ($100), whichever is greater.

Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations may not apply to you. In such jurisdictions, Fjord LLC’s liability shall be limited to the maximum extent permitted by law.

9. Indemnification

You agree to indemnify, defend, and hold harmless Fjord LLC, its officers, directors, employees, agents, affiliates, successors, and assigns from and against any and all claims, demands, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to:

  • Your use or misuse of the Service
  • Your violation of these Terms
  • Your violation of any law or the rights of any third party
  • Any files, data, or content you submit, upload, or process through the Service
  • Any harm caused by your actions or omissions

Fjord LLC reserves the right, at its own expense, to assume the exclusive defense and control of any matter subject to indemnification by you, in which event you will cooperate with Fjord LLC in asserting any available defenses.

10. Data Rights, Licensing, and Intellectual Property

User Content Ownership

You retain full ownership of the data, documents, and images you upload to the Service. By providing this data, you grant Fjord LLC a worldwide, non-exclusive, royalty-free license strictly limited to the right to:

  • Process, host, and securely store your files within the Firebase Product Family infrastructure solely to provide the Service to you.

Service Intellectual Property

The Service, including its design, AI architecture, features, functionality, text, graphics, logos, and software, is owned by Fjord LLC or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our express written permission.

Account Deletion and Data Removal

You may revoke the license granted above and request deletion of your account at any time. Upon account deletion, we will make reasonable efforts to permanently remove your data, documents, and images from our active systems; however, some encrypted information may remain in backups or logs as required by law for a reasonable period. We are not obligated to retain your data after account deletion.

11. Dispute Resolution, Arbitration, and Class Action Waiver

Informal Resolution

Before filing a claim, you agree to contact us at legal@bommel.bot to attempt to resolve the dispute informally. If we cannot resolve the dispute within 60 days, you may proceed to arbitration.

Binding Arbitration

You and Fjord LLC agree to resolve any disputes, claims, or controversies arising out of or relating to these Terms or the Service exclusively through binding arbitration, rather than in court, except for:

  • Small claims court actions (claims under $10,000)
  • Intellectual property disputes
  • Claims seeking injunctive or equitable relief

Arbitration will be conducted by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitration will take place in Santa Fe, New Mexico, and will be conducted in English. You waive any right to a jury trial.

Class Action Waiver

You and Fjord LLC agree that each may bring claims against the other only in your or its individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding. You waive any right to participate in a class action lawsuit or class-wide arbitration.

Statute of Limitations

Any claim or cause of action arising out of or related to these Terms or the Service must be filed within one (1) year after such claim or cause of action arose, or such claim or cause of action is forever barred.

12. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of New Mexico, United States, without regard to its conflict of law provisions.

For any disputes not subject to arbitration, you agree to submit to the exclusive personal jurisdiction of the state and federal courts located in Santa Fe County, New Mexico. You waive any objection to venue in such courts.

If you are accessing the Service from outside the United States, you are responsible for compliance with local laws. Fjord LLC makes no representation that the Service is appropriate or available for use in locations outside the United States.

13. Miscellaneous Provisions

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Fjord LLC regarding the Service and supersede all prior agreements and understandings.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

Waiver

No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term. Fjord LLC’s failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.

Assignment

You may not assign or transfer these Terms or your account without Fjord LLC’s prior written consent. Fjord LLC may assign or transfer these Terms or its rights and obligations without restriction.

Force Majeure

Fjord LLC shall not be liable for any failure or delay in performance under these Terms due to circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labor disputes, internet or telecommunications failures, or government actions.
